1. Acceptance of Terms
By engaging Redpoint Poinciana Concrete for services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the client) and Redpoint Poinciana Concrete. If you do not agree to these terms, please do not engage our services.
2. Services Provided
Redpoint Poinciana Concrete provides professional concrete installation, repair, and related services including but not limited to driveways, patios, foundations, retaining walls, and commercial flatwork. All services are performed in accordance with industry standards and local building codes. Specific scope of work will be detailed in individual project contracts or estimates.
3. Estimates and Pricing
Estimates provided are based on information available at the time of inspection and are valid for 30 days unless otherwise specified. Final pricing may vary if site conditions differ from initial assessment or if client requests changes to the scope of work. Any changes to the original estimate will be communicated and approved before proceeding. Payment terms will be specified in the project contract.
4. Project Timeline
Project timelines are estimates based on normal working conditions and material availability. Delays may occur due to weather, unforeseen site conditions, material delivery issues, or other factors beyond our control. We will communicate any delays promptly and work to minimize impact on project completion. Client delays in decision-making or site access may extend project timelines.
5. Client Responsibilities
Clients are responsible for providing accurate property information, obtaining necessary permissions from homeowners associations or landlords, ensuring clear access to work areas, protecting personal property, and making timely decisions regarding project details. Clients must also ensure payment according to agreed terms and provide safe working conditions for our crew.
6. Permits and Regulations
Redpoint Poinciana Concrete will obtain necessary permits for work when required and specified in the contract. Clients are responsible for disclosing any homeowners association requirements or deed restrictions. All work is performed in compliance with local building codes and regulations. Additional costs for permits or inspections will be communicated before proceeding.
7. Warranties
We warrant our workmanship for a period specified in your project contract. This warranty covers defects in workmanship but does not cover damage from improper use, lack of maintenance, natural disasters, or normal wear and tear. Concrete may develop minor hairline cracks due to natural curing and settling, which are not covered under warranty. Warranty claims must be submitted in writing within the warranty period.
8. Limitation of Liability
Redpoint Poinciana Concrete's liability is limited to the contract price of services provided. We are not liable for indirect, incidental, or consequential damages. We maintain appropriate insurance coverage and will address any property damage caused by our work. Claims must be reported within 48 hours of discovery.
9. Changes and Cancellations
Changes to project scope must be requested in writing and will be subject to additional charges if they increase work or materials required. Cancellations must be made in writing. Cancellation fees may apply if materials have been ordered or work has commenced. Deposits are non-refundable once materials are ordered or work begins.
10. Dispute Resolution
Any disputes arising from these terms or services provided will first be addressed through good faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in accordance with Florida law. The prevailing party in any dispute will be entitled to reasonable attorney fees and costs.
11. Modifications to Terms
Redpoint Poinciana Concrete reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the revision date. Continued use of our services after changes constitutes acceptance of modified terms. Material changes will be communicated to active clients.
